Terms of Service

BuilderSiteNow is a multi-tenant, cloud-hosted construction ERP. We provide access to the service over the internet on a subscription basis. We may update features at any time; we will not materially degrade core functionality without notice.

You agree to:

• Provide accurate sign-up information.
• Keep your passwords confidential. You are responsible for everything that happens under your account.
• Notify us promptly at security@buildersitenow.com of any suspected unauthorized access.
• Not use the service for unlawful or fraudulent activity, or to violate the rights of others.

The free tier is available indefinitely with the modules listed on our pricing page. Paid plans are invoiced in INR, with applicable GST.

You own the data you put into BuilderSiteNow. We are a processor; you are the controller.

Where statute requires us to retain certain records longer, we will.

We target 99.5% monthly uptime for the production service. Planned maintenance is announced in advance and scheduled outside Indian business hours where possible.

You may not:

• Use the service to send spam, malware, or harmful content.
• Probe, scan, or load-test our infrastructure without prior written consent.
• Reverse-engineer or scrape the product to build a competing service.
• Resell access to third parties without our written consent.

Both parties agree to keep confidential information shared during the engagement (technical, commercial, customer data) confidential, and to use it only for the purposes of providing or using the service.

The service is provided “as is” to the extent permitted by law. To the maximum extent permitted by Indian law, our aggregate liability arising out of or relating to these terms is limited to the fees you paid in the 12 months preceding the claim.

Neither party is liable for indirect, special, consequential, or punitive damages, including loss of profits or data, beyond the limits above.

Either party may terminate the agreement with 30 days' written notice. We may suspend or terminate immediately for unpaid invoices, breach of these terms, or unlawful activity. On termination, you retain ownership of your data and the export rights described above.

These terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu, unless we mutually agree to arbitration.

We may update these terms as the product evolves. Material changes will be announced inside the product and on this page; continued use after a change constitutes acceptance.
